The risks of trading and of using software and automation with your own accounts, which you accept and bear yourself.

1. Introduction

This Risk Disclosure forms part of the Terms of Service for the UltimaTrader website, web application, software and associated services (the “Platform”). By accessing or using the Platform, you confirm that you have read and understood this Risk Disclosure and that you accept the risks described in it.

This Risk Disclosure does not describe every risk. You should consider your own circumstances and, where appropriate, obtain independent professional advice.

2. Trading Involves Substantial Risk of Loss

TRADING STOCKS, DIGITAL ASSETS AND OTHER INSTRUMENTS INVOLVES SUBSTANTIAL RISK OF LOSS. You acknowledge that:

  • markets can be highly volatile and unpredictable;
  • you may lose some or all of the money you trade with;
  • no strategy, signal, analysis, AI feature or automation guarantees profits or prevents losses;
  • market conditions can change rapidly and without warning;
  • liquidity can disappear, prices can gap, and orders may be filled at prices worse than expected or not at all;
  • digital assets carry additional risks, including technology failures, fraud, loss of access and regulatory action;
  • changes in law or regulation may significantly affect markets, instruments and the services you use;
  • leverage, margin and short selling, where available to you at your broker or exchange, can result in losses greater than the money you deposited.

3. Software, AI and Automation

UltimaTrader is software and information. Any automation is a function of the software that you enable for your own account, within the settings you choose. You acknowledge that:

  • AI features and strategies are based on models and historical data that may be wrong, incomplete or no longer relevant;
  • the software, market data, internet connections, brokers, exchanges and their interfaces can fail, be delayed or behave unexpectedly;
  • orders may be rejected, duplicated, delayed or executed differently from what you intended;
  • automation acts quickly and can repeat an error before you notice it;
  • switching automation off, disconnecting an account or revoking an access key does not cancel or reverse orders already submitted or positions already open;
  • during early access, features may be incomplete and figures shown in the cabinet may be demonstration data that do not reflect any account.

4. Your Accounts and Access Keys

Your brokerage and exchange accounts, the money and assets in them, and the access keys you create are yours. You acknowledge that:

  • anyone who obtains your access keys or sign-in details may be able to place orders on your accounts;
  • even an access key without withdrawal rights can be used to place damaging orders;
  • the security of your accounts, devices, keys and passwords is your responsibility;
  • brokers and exchanges can fail, suspend trading, restrict access or become insolvent, and any protection scheme that applies is a matter between you and them.

5. Performance Figures

Performance figures shown on our website are advertising materials. Details are available on personal request and are discussed in personal communication. Past results do not guarantee future results. Your results may differ materially and may be negative.

6. Your Responsibility

You are solely responsible for:

  • deciding whether to trade, how much money to commit and whether to enable any automation;
  • choosing and reviewing your settings, and monitoring your accounts, orders and positions;
  • conducting your own research and due diligence;
  • understanding and managing the risks of the instruments and markets you trade;
  • complying with the laws, tax obligations and reporting requirements that apply to you;
  • seeking independent financial, legal or tax advice where appropriate.

7. No Advice and No Guarantee

Nothing on the Platform is investment, financial, legal or tax advice, or a recommendation to buy, sell or hold any instrument. UltimaTrader does not trade on your accounts, does not manage your accounts or assets, does not make investment decisions for you and does not hold your money.

UltimaTrader gives no guarantee of any result and accepts no liability for trading losses, as set out in our Terms of Service.
